Thousands of vaginal mesh lawsuits (http://www.transvaginalmeshlawsuithelp.com/) filed against C.R. Bard, Inc. continue to move forward in a federal multidistrict litigation underway in U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. The Order indicates that the first such conference will be convened on Friday, September 26, 2014 at 3:00 p.m. (In re C.R. Bard Inc. Pelvic Repair System Products Liability Litigation, MDL No. 2187)

“We are pleased to see continued progress in the federal litigation, as our Firm is representing numerous women who have filed vaginal mesh lawsuits in this proceeding,” says Bernstein Liebhard LLP, a nationwide law firm representing the victims of defective drugs and medical devices. The Firm continues to offer free legal evaluations to women who have suffered serious vaginal mesh complications, allegedly due to pelvic mesh devices manufactured by C.R. Bard, as well as American Medical Systems, Inc., Ethicon, Inc. and Boston Scientific Corp.

Transvaginal Mesh Litigation
Court records indicate that more than 9,000 transvaginal mesh lawsuits have been filed against C.R. Bard in the Southern District of West Virginia, where Bernstein Liebhard LLP partner, Jeffrey S. Grand, serves on the Plaintiffs’ Steering Committee. All of the lawsuits claim that the company’s surgical mesh devices used in the treatment of stress urinary incontinence and pelvic organ prolapse caused recipients to suffer serious and painful complications, including mesh erosion, scarring, infection and organ damage. Among other things, C.R. Bard is accused of failing to provide adequate warnings regarding the serious risk of vaginal mesh complications associated with the devices.

According to court documents, some trials have already concluded in state and federal litigations involving C.R. Bard vaginal mesh lawsuits. In July 2012, a California Superior Court jury ordered C.R. Bard to pay a $3.6 million portion of a $5.5 million judgment awarded to a recipient of an Avaulta mesh device. (Scott v. Kannappan, S-1500-CV-266034-WDE, Superior Court for Kern County, California (Bakersfield))

The federal litigation's first C.R. Bard bellwether trial concluded in August 2013, when another Avaulta recipient was awarded $2 million. (Cisson v. C.R. Bard Inc., 11-cv-00195)

According to court documents, more than 60,000 transvaginal mesh lawsuits have been filed in the Southern District of West Virginia against a number of pelvic mesh manufacturers. Bernstein Liebhard LLP partner, Jeffrey S. Grand, is also serving on the Plaintiffs' Steering Committees for several of these proceedings, including: In re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation - MDL No. 2325; In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation - MDL No. 2326; and In re: Ethicon, Inc. Pelvic Repair Systems Products Liability Litigation - MDL No. 2327.

Mr. Grand was also named Co-Liaison Counsel in two consolidated litigations established for C.R. Bard and Ethicon mesh lawsuits in New Jersey's Atlantic Superior Court. He was also a member of the trial team on the first Ethicon trial, which ended in March 2013 with an $11 million verdict for the Plaintiff. (In re: Pelvic Mesh/Gynecare Litigation, No. 6341-10; In re: Pelvic Mesh Litigation/Bard, No. L-6339-10).

Alleged victims of serious vaginal mesh complications may be entitled to compensation for their injury-related damages.
