Vaginal Mesh Lawsuit News: Discovery Conferences Scheduled for Federal Transvaginal Mesh Lawsuits Filed Against C.R. Bard, Bernstein Liebhard LLP Reports

According to an Order dated September 15, 2014, the Court has determined that bi-weekly telephonic discovery conferences would be beneficial to the proceeding. Transvaginal Mesh Litigation
Court records indicate that more than 9,000 transvaginal mesh lawsuits have been filed against C.R. Bard in the Southern District of West Virginia, where Bernstein Liebhard LLP partner, Jeffrey S. Grand, serves on the Plaintiffs’ Steering Committee. All of the lawsuits claim that the company’s surgical mesh devices used in the treatment of stress urinary incontinence and pelvic organ prolapse caused recipients to suffer serious and painful complications, including mesh erosion, scarring, infection and organ damage. Among other things, C.R. Bard is accused of failing to provide adequate warnings regarding the serious risk of vaginal mesh complications associated with the devices.
According to court documents, some trials have already concluded in state and federal litigations involving C.R. Bard vaginal mesh lawsuits. In July 2012, a California Superior Court jury ordered C.R. Bard to pay a $3.6 million portion of a $5.5 million judgment awarded to a recipient of an Avaulta mesh device. (Scott v. The federal litigation's first C.R. Bard bellwether trial concluded in August 2013, when another Avaulta recipient was awarded $2 million. (Cisson v. C.R. Bard Inc., 11-cv-00195)
According to court documents, more than 60,000 transvaginal mesh lawsuits have been filed in the Southern District of West Virginia against a number of pelvic mesh manufacturers.
