According to the Daily Breeze , the woman was walking her bike across a Manhattan Beach, CA, street when she was struck and killed by an underage drunk driver, marking the 12th bicycling fatality in Southern California this year. “Due to the warm weather and advent of spring, more people will begin to participate in outdoor activities, including many cyclists, and one must always determine whether they have adequately protected themselves against an unfortunate accident,” said Jeffrey R. Marquart, managing partner of The Marquart Law Group.

Many people obtain insurance relative to their vehicles and homes, and those who are abundantly prudent obtain what is called an “umbrella policy.” An umbrella policy protects people in the event of negligence; for example, bumping into somebody in a grocery store and knocking them down, etc. All of these insurances, adds Marquart, are intended to do one thing and one thing only: protect you in the event you are negligent.

“Everyone focuses on the protection of their assets, but they fail to take the next step in their insurance analysis, which is how to protect themselves from the negligence of others,” said Marquart. “If you knew about all the people around you on the roadways who are texting, distracted, intoxicated or otherwise impaired, you would make sure to insure yourself properly.”

The way to do that is to obtain uninsured motorist coverage for the highest limit possible. This is also important for those who jog or bike in the travel lanes of public roadways. As cyclists know, there are a plethora of disabling and deadly accidents that occur weekly throughout this country.

Marquart presents a scenario in which one has insured oneself for $2 million. This means if they were to run into somebody in their car and kill them, their assets would protect up to $2 million.

“Now twist that scenario around: You are riding your bicycle on a 20-mile workout ride when a teenager veers off the road while texting and either disables you or kills you,” said Marquart. “How much insurance do you think that teenager has? In California the minimum required insurance is $15,000/$30,000/$5,000. This is where uninsured/underinsured motorist protection comes into play. If you had the foresight to insure yourself properly, your family would not suffer financial ruin.”
