As da Vinci robot lawsuits (http://www.davincisurgery-lawsuit.com) continue to mount in courts around the country, Bernstein Liebhard LLP notes cautionary comments made by one prominent surgeon and researcher that aired during a recent CNN report on the proliferation of robotic surgery. According to Dr. Martin Makary, a senior surgeon at the John Hopkins Medical Institute, the fact that the robot cannot feel tissue in the way that a surgeon’s hands would poses a unique problem that could lead to inadvertent patient injuries. Dr. Markey also asserted that in most of the operations where robotic surgery is used, there's no benefit to the patient compared to other methods.*

Robotic Surgery Lawsuits
According to CNN, more than 2,500 da Vinci Surgical Systems have been sold worldwide since the device was launched in 2000 by Intuitive Surgical, Inc. However, NBC News reported in June that the U.S. Food & Drug Administration (FDA) has received more than 200 reports of da Vinci patients who suffered burns, cuts and infections since 2007, including 89 that involved patient deaths. The growing number of da Vinci complications has attracted scrutiny from the FDA, and in January it launched a survey of doctors to determine if the increase was related to a problem with the technology. ** In July, Intuitive Surgical received an FDA Warning Letter that cited the company for, among other things, failing to properly report certain adverse events and device corrections to the agency.
On July 22, 2013, an Intuitive Surgical regulatory filing disclosed that the company had been named in 33 individual robotic surgery lawsuits filed in various state and federal courts that allege use of the da Vinci caused patients to suffer serious, and in some cases fatal, injuries. Intuitive also disclosed that it had entered into tolling agreements in some of these cases, “in an effort to provide an orderly process for evaluating claims before they result in costly litigation.” ***
