da Vinci Lawsuit News: Rottenstein Law Group LLP Comments on News That Surgical Robot Problems Not Reported to FDA

The study, originally published in the Journal for Healthcare Quality, focused on 12 years of data from use of Intuitive Surgical’s da Vinci surgical robot involving 245 reported incidents, which included 71 deaths and 174 injuries, according to a Nov. 1 article in Med City News.*
“The study is disconcerting,” said Rochelle Rottenstein, principal of the Rottenstein Law Group LLP. “There are known alleged dangers associated with the da Vinci surgical robot; other studies indicate that. What this one says, though, is that those dangers are not always being reported to the U.S. Food and Drug Administration.”
The da Vinci features four robotic arms with precision surgical tools and cameras that are supposed to allow a surgeon to perform procedures such as hysterectomies and prostate removals less invasively than traditional methods. The device has been found to cause potentially dangerous side effects, such as internal burns, nerve damage and lacerations, according to a Sept. 9 New York Times report.** Additionally, in July Intuitive Surgical initiated a class-2 recall of about 30 da Vinci units because of potential safety issues, according to a July 12 Bloomberg story.***
