As Intuitive Surgical, Inc. faces a growing number of da Vinci robot lawsuit (http://www.davincirobotlawsuithelp.com/) filings involving its da Vinci Surgical System, Bernstein Liebhard LLP notes that a new report from Bloomberg.com is raising additional questions about many of the claims made in marketing materials for the popular robotic surgical platform. According to the October 8th report, much of the advertising employed to promote use of the da Vinci robot promises that such procedures are associated with fewer complications, despite the existence of some studies that have found no advantage between robotic surgery and more traditional procedures. Among other things, Bloomberg.com points out that there exists no randomized trials proving that robotic procedures offer significant health benefits compared to standard, less-invasive surgery, while at the same time numerous studies have shown that robotic surgery is often far more expensive than other options.*

According to Bloomberg.com, the da Vinci robot was used in more than 350,000 operations last year, a 60 percent jump since 2010. The report maintains that much of that growth is driven by marketing that promises patients better outcomes. “If there was a Nobel Prize for marketing, it would go to Intuitive Surgical,” one doctor told Bloomberg.com.
At the same time, the number of da Vinci complication reports made to the U.S. Food & Drug Administration (FDA) have also increased, with reports doubling in the first 8 months of this year, according to Bloomberg.com. For its part, Intuitive Surgical maintains that the increase in adverse event reports involving the da Vinci is merely indicative of a rise in the frequency of reporting, rather than a rise in actual incidents.*
Intuitive Surgical disclosed in a regulatory filing released over the summer that it had been named in at least 33 da Vinci robot lawsuits that allege the device caused patients to suffer serious, and in some cases deadly, robotic surgery complications. Some of these lawsuits also question the marketing tactics used to convince hospitals, doctors and patients to utilize the da Vinci Surgical System.**
