Da Vinci Robot Lawsuits
According to a report released earlier this month from the U.S. Food and Drug Administration (FDA), a total of 3,697 adverse event reports associated with the da Vinci Surgical System were recorded by the federal agency as of November 3, 2013.* These complaints, which were reported throughout the course of the year, represent an increase from 2012, when the federal agency logged just 1,595 reports, the FDA stated.
Doctors included in a survey released by the agency also reported injuries stemming from procedures aided by the da Vinci Surgical System. The 11 surgeons contained in the study had performed between 70 and 600 robotic procedures each, during which they reportedly observed instances of temporary nerve damage in the fingers, seromas in obese patients, bleeding from perforated bowels, peripheral vision loss, reversible limb palsy and urethral stricture/stenosis.
Just a few weeks earlier, Bloomberg.com reported that Intuitive Surgical had acknowledged its involvement in at least 50 da Vinci robot lawsuits. This news was included in a regulatory filing issued by the company in October, when officials said plaintiffs involved in cases over the da Vinci alleged that the device was defectively designed, and that Intuitive failed to warn doctors and patients about its principal product’s risk to cause serious patient complications.** In July 2013, the FDA sent a warning letter to Intuitive after inspectors for the agency found that the company had failed to report corrections made to the da Vinci, as well as adverse event reports associated with the surgery robot.***
