DePuy ASR Lawsuits Move Forward, as Bernstein Liebhard LLP Notes Release of New Pretrial Order in New Jersey DePuy ASR Recall Litigation
New York, New York (PRWEB) August 07, 2013 -- Lawsuits filed in the wake of the 2010 DePuy ASR recall (http://www.depuy-asr-hip-recall.com/) continue to move forward in a Multicounty Litigation now underway in New Jersey’s Bergen County Superior Court, Bernstein Liebhard LLP reports. According to a Pretrial Order issued on July 26th, the court has established deadlines for submission of proposed jury questionnaires, verdict forms and jury instructions for the litigation’s first bellwether trial. Among other things, the Order also stipulates that any motions for dismissal or summary judgment must be filed with the Court by September 17th. DePuy ASR Lawsuits
According to the U.S. Food & Drug Administration, a worldwide recall was announced in August 2010 for DePuy ASR hip implants, after the metal-on-metal devices were found to be failing prematurely in an unexpectedly high number of recipients. Since then, Johnson & Johnson and its DePuy Orthopaedics unit have been named in more than 11,000 DePuy ASR lawsuits, all of which allege that toxic metal debris shed from the device caused plaintiffs to suffer metallosis, premature device failure and other serious complications that in some cases resulted in revision surgery. Earlier this year, two DePuy ASR trials concluded in California and Illinois state courts. In March, a Los Angeles Superior Court jury found that the ASR was defectively designed, and awarded more than $8 million to the Plaintiff in that case. (Kransky v.
