DePuy ASR Lawsuits Move Forward, as Bernstein Liebhard LLP Notes New Pre-trial Ruling in Federal DePuy ASR Recall Litigation

In an Order issued on July 26th, U.S. District Judge David A. DePuy ASR Recall
According to court documents, more than 11,000 DePuy ASR lawsuits have been filed in courts around the country since the August 2010 recall of the DePuy ASR XL Acetabular Hip System. At least 7,800 such claims are pending in the Northern District of Ohio. Plaintiffs in these lawsuits allege that the ASR’s metal-on-metal design has resulted in serious complications, including premature device failure necessitating revision surgery. The first bellwether trial in the federal proceeding will begin on September 9, 2013.
Shortly after the DePuy ASR recall was announced, the U.S. Food & Drug Administration (FDA) embarked on a safety review of metal-on-metal hip implants. In January, the agency cautioned that these devices may shed dangerous amounts of metal debris, resulting in pain, adverse local tissue reactions, metallosis, and premature failure of the hip. The agency has proposed new rules that would subject such hip implants to more regulatory oversight. The FDA has also advised metal-on-metal hip recipients to undergo medical screening if they experience any symptoms of a failing hip implant, including pain, swelling at the joint, loosening of the hip, or audible clicking, squeaking, or popping sounds coming from the joint.
