DePuy ASR hip lawsuits (http://www.depuy-asr-hip-recall.com/) continue to move forward in a MultiCounty Litigation underway in New Jersey’s Bergen County Superior Court, Bernstein Liebhard LLP reports. According to an Order dated August 13th, Superior Court Judge Brian R. Martinotti has rejected DePuy Orthopaedics’ motion to split the consolidated trial of two bellwether cases in the proceeding. The first bellwether trial in the New Jersey DePuy ASR recall litigation is scheduled to begin on October 21, 2013. (In Re DePuy ASR Hip Implants Litigation, BER-L-3971-11)

DePuy ASR Recall
According to the U.S. Food & Drug Administration (FDA), the DePuy ASR recall was announced in August 2010, due to the high failure rates associated with the metal-on-metal hip replacement devices. Court documents indicate that more than 650 DePuy ASR lawsuits are pending in the New Jersey litigation, all of which allege the metal-on-metal design of the ASR hip caused the device to shed dangerous amounts of metal debris. Plaintiffs claim this caused a number of serious complications, including pain, swelling, and metallosis, which sometimes resulted in revision surgery to replace the failing hip.
Bernstein Liebhard LLP is actively filing DePuy ASR lawsuits in a federal multidistrict litigation underway in U.S. District Court, Northern District of Ohio, where more than 7,800 similar claims have been filed. Two trials involving DePuy ASR recall claims have already concluded in other states. In March, a plaintiff was awarded more than $8 million after a Los Angeles Superior Court jury found that the ASR was defectively designed. (Kransky v. DePuy, BC456086, California Superior Court, Los Angeles County) However, a jury in Chicago found for Johnson & Johnson in a second trial just one month later. (Strum v. DePuy, 2011-L-9352, Circuit Court of Cook County)
