Thousands of DePuy ASR lawsuits (http://www.depuy-asr-hip-recall.com/) filed in the wake of the August 2010 DePuy ASR hip recall continue to move forward in state and federal courts throughout the country, Bernstein Liebhard LLP reports. According to court documents filed in a multicounty litigation established for DePuy ASR recall claims in New Jersey’s Bergen County Superior Court, the Court has scheduled a Pretrial Conference for October 8th at 9:30 a.m. The litigation’s first trial is scheduled to begin on October 21, 2013, and will involve two DePuy ASR lawsuits filed in the proceeding. In an Order dated August 13th, Superior Court Judge Brian R. Martinotti denied a defense request that sought separate trials for the two lawsuits. DePuy ASR Recall Litigation
Court documents from around the country indicate that more than 11,500 lawsuits have been filed since the DePuy ASR recall was announced. In addition to more than 650 claims pending in New Jersey, more than 8,200 DePuy ASR lawsuits have been filed in a multidistrict litigation underway in U.S. District Court, Northern District of Ohio, where Bernstein Liebhard LLP is actively filing claims. According to a recent report from Bloomberg.com, a DePuy ASR lawsuit will also go to trial next month in California, while a Chicago jury will begin hearing a case in December.*
All of these lawsuits were filed on behalf of patients who allegedly suffered serious complications, due to toxic metal debris that can be shed from the ASR hip’s chromium-cobalt ball and cup as a result of wear. According the U.S. Food & Drug Administration, the DePuy ASR recall was announced after data from a United Kingdom hip registry indicated that 12-to-13% of recipients experienced device failure within just five years of having the ASR implanted. However, as Bloomberg.com pointed out, estimates of the ASR’s actual failure rate continue to rise.*
Earlier this year, the nation’s first two trials involving DePuy ASR lawsuits concluded at the state court level. In March, a plaintiff was awarded more than $8 million after a Los Angeles Superior Court jury found that the hip implant was defectively designed. (Kransky v. DePuy, BC456086, California Superior Court, Los Angeles County) However, a jury in Chicago found for Johnson & Johnson in a second trial just one month later. (Strum v.
