A court conference has been scheduled to address the hundreds of DePuy ASR hip lawsuits (http://www.consumerinjurylawyers.com/DePuy/) currently pending in a multicounty litigation underway in New Jersey’s Bergen County Superior Court, Bernstein Liebhard LLP reports. According to documents filed in the proceeding, the Court will hold the year’s first Case Management Conference on January 29, 2014. (In Re DePuy ASR Hip Implants Litigation, BER-L-3971-11)

DePuy ASR Settlement
The DePuy ASR settlement proposal was announced on November 19, 2013, in U.S District Court, Northern District of Indiana, where thousands of claims stemming from the 2010 ASR recall have been consolidated for pretrial proceedings. According to court documents, if it is finalized, the settlement will apply to DePuy ASR lawsuit plaintiffs who underwent revision surgery to replace their artificial hip due to a recall-related reason prior to August 31, 2013. Eligible claimants would be entitled to a base award of $250,000. That award could be reduced, however, depending on certain other factors, including their prior medical history.
Other circumstances could entitle plaintiffs to a supplemental award if they, for example, required multiple revision surgeries, or if they experience “certain extraordinary injuries” in the future. Claimants who might wish to participate in the settlement program were required to register their claims by January 6, 2014. The Court has also designated April 1, 2014 as the final deadline for opting in or out of the DePuy ASR settlement. (In re: DePuy Orthopaedics, Inc. According to The New York Times, if the DePuy ASR settlement is finalized, it is expected to cost Johnson & Johnson and its DePuy Orthopaedics unit at least $2.5 billion. If the accord is accepted by 94% of eligible plaintiffs, it would resolve roughly 8,000 of the 12,000 claims currently pending against the companies in federal and state courts around the country. Individuals who are not eligible for the settlement program, or those who elect not to participate, will still be able to pursue individual DePuy ASR lawsuits.*
