A Case Management Conference will be held on April 9, 2014, to address the hundreds of DePuy ASR hip lawsuits (http://www.consumerinjurylawyers.com/DePuy/) currently pending in a multicounty litigation underway in New Jersey’s Bergen County Superior Court, Bernstein Liebhard LLP reports. According to court documents, at least 653 claims stemming from the 2012 DePuy ASR recall are pending in the proceeding. (In Re DePuy ASR Hip Implants Litigation, BER-L-3971-11).

The cases pending in New Jersey are among more than 12,000 DePuy ASR lawsuits that were filed after the metal-on-metal hip implants were recalled in August 2010. According to court documents, the majority of these claims are pending in a multidistrict litigation underway in U.S. District Court, Northern District of Indiana. All of the lawsuits were filed on behalf of ASR recipients who suffered metallosis, chronic pain, premature device failure and other complications allegedly related to the metal-on-metal design of the ASR hip system. On November 19, 2013, a DePuy ASR settlement proposal was unveiled in the Northern District of Indiana which could ultimately resolve around 8,000 of the claims pending against DePuy Orthopaedics and Johnson & Johnson. If the accord is finalized, eligibility will be limited to DePuy ASR lawsuit plaintiffs who underwent revision surgery to replace their artificial hip due to a recall-related reason prior to August 31, 2013. Eligible claimants would be entitled to a base award of $250,000. That award could be reduced, however, depending on certain other factors, including their prior medical history. Other circumstances could entitle plaintiffs to a supplemental award if they, for example, required multiple revision surgeries, or if they experience “certain extraordinary injuries” in the future.

The Court has designated April 1, 2014 as the final deadline for opting in or out of the DePuy ASR settlement. According to a report from The New York Times, the DePuy ASR settlement must be accepted by 94% of eligible plaintiffs before it can become final. Plaintiffs who do not wish to participate, or those who are not eligible, will still be permitted to pursue individual claims against DePuy and Johnson & Johnson.
