DePuy ASR Hip Litigation
According to court documents, more than 7,000 DePuy ASR hip lawsuits have been filed in the Northern District of Ohio on behalf of individuals who allegedly suffered painful and debilitating complications due to the hips metal-on-metal design. The artificial hips were recalled in August 2010 after data indicated that the devices were failing at an unacceptably high rate within just five years of implantation.* All of the lawsuits pending in the proceeding allege that DePuy Orthopaedics failed to subject the devices to sufficient testing to ensure their safety, and did not adequately warn patients about their potential risks.

Court records indicate that a DePuy ASR settlement program was announced in the Northern District of Ohio on November 19, 2013, and could ultimately resolve the majority of cases involving the recalled hip implant that are currently pending in state and federal courts. Initially, participation in the program was limited to DePuy ASR recipients who had undergone revision surgery due to a recall-related reason prior to August 31, 2013. However, an Order issued by the Court on February 20th expanded the settlement to include those who had undergone a revision by January 31, 2015.

According to court documents, the DePuy ASR settlement program will provide a base award of $250,000 to each eligible plaintiff. However, some plaintiffs may be eligible for a larger award if they, for example, required multiple revision surgeries, or if they experience "certain extraordinary injuries" in the future. In other cases, the base award may be reduced depending on certain other factors, including prior medical history.

Individuals who allegedly suffered serious complications related to the DePuy ASR recall, including metallosis, adverse local tissue reactions, chronic pain, or premature device failure, may be entitled to compensation for their injury-related damages.
