DePuy ASR hip lawsuits (http://www.consumerinjurylawyers.com/DePuy/) filed in a multicounty litigation underway in New Jersey’s Bergen County Superior Court continue to move forward, Bernstein Liebhard LLP reports. According to court documents, a conference will be held in the proceeding on January 29, 2014. Just over 650 lawsuits filed in the wake of the August 2010 DePuy ASR recall are pending in the consolidated litigation. (In Re DePuy ASR Hip Implants Litigation, BER-L-3971-11)

DePuy ASR Settlement
According to court documents, the DePuy ASR lawsuits pending in Bergen County Superior Court are among more than 12,000 claims filed in courts nationwide since the ASR hips were recalled from the market in August 2012 for an unacceptable rate of premature failure. The majority of claims filed since the DePuy ASR recall are pending in a federal multidistrict litigation underway in U.S. District Court, Northern District of Ohio.( In re: DePuy Orthopaedics, Inc. ASR Hip Implant Products Liability Litigation – MDL 2197) All of the lawsuits similarly allege that plaintiffs suffered metallosis, premature device failure and other serious complications due to the ASR’s metal-on –metal design.
On November 19th, a DePuy ASR settlement was announced in the Northern District of Ohio that could potentially resolve some 8,000 claims pending nationwide against Johnson & Johnson and DePuy Orthopaedics. According to court documents, eligible plaintiffs will be entitled to a base award of $250,000. That award could be reduced, however, depending on certain other factors, including their prior medical history. Other circumstances could entitle plaintiffs to a supplemental award if they, for example, required multiple revision surgeries, or if they experience “certain extraordinary injuries” in the future.
According to the DePuy ASR settlement agreement, plaintiffs eligible to participate in the program include ASR recipients who underwent revision of their artificial hip due to injuries related to the DePuy ASR recall no later than August 31, 2013. The settlement must be accepted by 94% of eligible claimants before it can be finalized. According to court documents, those plaintiffs not eligible to participate may still pursue an individual lawsuit against DePuy and Johnson & Johnson.
