Federal Court Overseeing DePuy ASR Hip Lawsuit Set to Convene Conference in January, Bernstein Liebhard LLP Reports
New York, New York (PRWEB) December 25, 2014 -- Product liability lawsuits filed in the wake of the 2010 DePuy ASR hip recall (http://www.consumerinjurylawyers.com/DePuy/) continue to move forward in federal court, Bernstein Liebhard LLP reports. According to an Order issued in the U.S. District Court, Northern District of Ohio on November 20th, the Court will convene an open conference on January 7, 2015, at the Paul G. Rogers Federal Building and United States Courthouse in West Palm Beach, Florida. The Conference is scheduled to begin at 10:30 a.m. (In re: DePuy Orthopaedics, Inc. Court documents indicate that the January 7th conference will address data pertaining to DePuy ASR lawsuits that have been filed on behalf of plaintiffs who underwent revision surgery after August 31, 2014. Such plaintiffs were not eligible to participate in the DePuy ASR settlement announced by the Court in November 2013.

According to court documents, nearly 8,000 DePuy ASR hip lawsuits have been filed in the Northern District of Ohio on behalf of individuals who allegedly suffered painful and debilitating complications due to its metal-on-metal design. The artificial hips were recalled in August 2010 after data indicated that the devices were failing at an unacceptably high rate within just five years of implantation.*
The DePuy ASR settlement program was announced in the Northern District of Ohio on November 19, 2013, and could ultimately resolve the majority of cases involving the recalled hip implant that are currently pending in state and federal courts. However, in order to participate in the program, DePuy ASR recipients must have undergone revision surgery due to a recall-related reason prior to August 31, 2013.
