DePuy ASR Recall Litigation Moves Forward, as Federal Court Schedules Conference, Bernstein Liebhard LLP Reports

According to an Order issued in the U.S. District Court, Northern District of Ohio on January 2, 2015, the conference will take place on January 30, 2015 at the Paul G. Rogers Federal Building and United States Courthouse in West Palm Beach, Florida. The proceeding will commence at 10:30 a.m., in a courtroom to be determined at a later date. DePuy ASR Recall
DePuy Orthopaedics recalled its metal-on-metal line of ASR hip implants in August 2010. According to the U.S. Food & Drug Administration (FDA), the recall was issued after data from a United Kingdom joint registry indicated that the 5 year revision rate associated with the devices was approximately 13 percent. Since then, court records indicate that thousands DePuy ASR lawsuits have been filed in courts throughout the country, most of which are pending in a federal multidistrict litigation underway in U.S. District Court, Northern District of Ohio.
On November 19, 2013, the DePuy ASR settlement program was announced in the Northern District of Ohio. Court documents indicate that those eligible to participate in the program include patients who underwent revision surgery to replace their ASR hip due to a recall-related reason prior to August 31, 2013. According to an Order dated October 30, 2014, those plaintiffs who have not undergone revision surgery, and who are therefore not eligible to participate in the settlement program, have been offered tolling agreements that would suspend the statute of limitations for their claims in return for voluntary dismissal of their cases. Those who opt to enter into such a tolling agreement would be entitled to refile their DePuy ASR lawsuit should they later require revision surgery. Non-revision plaintiffs have been directed to inform the Court of their decision in this matter by January 31, 2015.
