DePuy Hip Replacement Lawsuit News: Lawsuit Chosen for First ASR Trial in Federal Court, Rottenstein Law Group LLP Reports
(PRWEB) July 12, 2013 -- This week a federal judge in Ohio chose a DePuy ASR lawsuit to be the first bellwether trial in the federal consolidation of ASR hip lawsuits. Plaintiff Ann McCracken, of Rochester, N.Y., filed the lawsuit against Johnson & Johnson subsidiary DePuy Orthopaedics, alleging that her DePuy ASR XL metal-on-metal hip implant failed, which required her to undergo corrective surgery, according to court documents in McCracken v. DePuy Orthopaedics Inc., et al. (1:11-dp-20485; U.S. District Court for the Northern District of Ohio). The lawsuit is one of the more than a thousand that were consolidated into a multidistrict litigation for pretrial efficiency, according to court documents in In re: DePuy Orthopaedics Inc., ASR Hip Implant Products Liability Litigation (MDL-2197; U.S. District Court for the Northern District of Ohio).

The DePuy ASR hip implant, recalled in 2010, has been under U.S. Food and Drug Administration scrutiny, primarily because of one potentially dangerous side effect called “metal poisoning,” or “metallosis.” According to the FDA*, cobalt and chromium ions could flake off into the patient’s bloodstream when the device’s metal components rub together. This could lead to potentially severe health problems.
