According to court documents dated July 18th, U.S. District Judge David A. Katz of the Northern District of Ohio has ruled that document production requests from parties in Australian DePuy ASR lawsuits not be permitted pending application to the multidistrict litigation. Court records indicate that more than 11,000 DePuy ASR lawsuits are now pending in U.S. Courts, with the majority filed in the federal multidistrict litigation. Two DePuy ASR recall claims have already gone to trial at the state level, with one plaintiff awarded more than $8 million in March. (Kransky v. DePuy, BC456086, California Superior Court, Los Angeles County) However, a second jury found for DePuy Orthopaedics in a second trial just one month later. (Strum v. DePuy, 2011-L-9352, Circuit Court of Cook County) The First bellwether trial of a federal DePuy ASR lawsuit is scheduled to begin on September 9, 2013.
Plaintiffs in DePuy ASR lawsuits allege that metal debris shed from the hip replacements can accumulate to dangerous levels in the tissue surrounding the joint, as well as the blood stream, resulting in metallosis, premature device failure and other serious complications that may necessitate revision surgery. According to the U.S. Food & Drug Administration, the DePuy ASR recall was announced in August 2010, after data from a joint registry in the United Kingdom found that early revision rates for the all-metal hip were as high as 13%.
