Dozens of New DePuy Pinnacle Hip Lawsuits Now Filed in Texas Federal Court Litigation, Bernstein Liebhard LLP Reports

Bernstein Liebhard LLP notes the recent filing of documents in the U.S. District Court, Northern District of Texas that reflect an increase in the number of DePuy Pinnacle hip lawsuits ( now pending in the federal litigation.

According to a Master Case List updated on January 1st, 2015, a total of 7,161 claims involving a metal-on-metal version of the DePuy Pinnacle Hip Replacement System are now centralized in the federal proceeding. Plaintiffs in these cases similarly allege pain, swelling, a loss of mobility and other symptoms associated with metallosis (metal ion poisoning) that resulted from implantation of the device. When court records were released on December 1, 2015, 30 fewer DePuy Pinnacle lawsuits had been filed. (In re: DePuy Orthopaedics Inc. DePuy Pinnacle Hip Lawsuits

Court documents indicate that all DePuy Pinnacle hip lawsuits now pending in Texas federal court involve the version of the device that includes a metal Ultamet liner, which has been associated with premature device failure and a range of serious complications that may include but are not limited to chronic pain and metallosis. According to plaintiffs, consumers were inadequately warned about these risks by DePuy Orthopaedics, a subsidiary of Johnson & Johnson. DePuy Pinnacle lawsuits further allege that the device shares flaws with the company’s ASR hip implant, which was recalled in August 2010 for unusually high rates of premature device failure. They further question whether the Pinnacle should have been recalled by the company as well. Jeffrey S. Grand, a partner at Bernstein Liebhard LLP, is currently an active member of the Plaintiffs Steering Committee in the federal litigation involving this metal-on-metal hip replacement.

This version of the DePuy Pinnacle Hip Replacement is no longer sold on the U.S. market, following its manufacturer’s decision in May 2013 to discontinue the availability of this device, and several products. Johnson & Johnson and DePuy cited slowing demand for its metal-on-metal implants as the reason for its decision to pull them, rather than safety concerns from the U.S. Food and Drug Administration (FDA). That January, the federal regulator warned that these hip replacements were more likely to fail prematurely than those made of other materials.*
