According to an Order dated September 20, 2013, the parties will now be permitted to conduct electron microscopy and focused ion beam examination on Pinnacle components explanted from potential bellwether trial plaintiffs in accordance with protocols established by the Court. Pinnacle Hip Lawsuits
More than 4,800 DePuy Pinnacle lawsuits are now pending in the litigation underway in Texas. According to court records, the proceeding’s first bellwether trial, which could provide valuable insight into how juries might rule in similar claims, is scheduled to begin in September 2014. All of the pending Pinnacle hip lawsuits involve a metal-on-metal version of the hip system that utilizes the Ultamet liner, which allegedly has a propensity to shed dangerous amounts of metal ions into surrounding tissue and the blood stream. Among other things, plaintiffs question whether the all-metal Pinnacle should have been subject to a recall, as they claim the device suffers from similar flaws that resulted in DePuy Othropaedics' worldwide recall of its ASR hip replacement line in August 2010.
Metal-on-metal hips like the all-metal Pinnacle are currently the subject of a safety review being conducted by the U.S. Food & Drug Administration (FDA). On January 17th, the agency proposed a new regulation that would require the manufacturers of metal-on-metal hips currently on the market to conduct post-market safety studies of those products in order to keep selling them. On May 17th, The New York Times reported that DePuy Orthopaedics had decided to phase out sales of all-metal hips, including the Pinnacle, due in part to the recent actions taken by the FDA.*
