More than 150 DePuy Pinnacle lawsuit (http://www.depuypinnacle-lawsuit.com/) claims have been added in less than a month to a fast-growing federal hip replacement litigation currently pending in the U.S. District Court, Northern District of Texas, Bernstein Liebhard LLP reports.
According to a Master Case List update on October 1st, a total of 5,037 cases have now been filed in the proceeding over a version of the DePuy Pinnacle Hip Replacement System that includes a metal Ultamet liner. Approximately 4,880 cases alleging injuries caused by the artificial hip were pending in the litigation as of September 3rd. (In re: DePuy Orthopaedics Inc. DePuy Pinnacle Lawsuits
DePuy Pinnacle lawsuits filed in the federal Texas litigation allege that the metal-on-metal version of the hip replacement device, which includes an Ultamet liner, has the potential to shed metallic debris into its recipient’s blood stream. In turn, this may cause pain, swelling, metallosis and other premature device failure complications that often require revision surgery to correct. Plaintiffs involved in these cases argue that the metal implant shares design qualities with the DePuy ASR device, which was recalled in August 2010 due to excessively high rates of early failure within five years.
A day before the federal litigation released its most recent Master Case List update, the Court issued an Order on September 30th requiring that all Pinnacle suits, with the exception of those that have already been selected to serve as its bellwether cases, be stayed in the proceeding until those trials have concluded. Court records indicate that the first trials in this proceeding have been scheduled to begin in September 2014.
On May 17th, the New York Times reported on DePuy Orthopaedics’ decision to phase out sales of its all-metal hip implants, including the metal version of the Pinnacle. This decision was owed in part to a proposal released in January by the U.S. Food and Drug Administration (FDA) that would require all metal hip manufacturers to submit new products for pre-market approval, and to conduct post-market safety studies for products already on the market in order to continue selling them.*
