DePuy Pinnacle hip lawsuit (http://www.depuypinnacle-lawsuit.com/ ) claims alleging injuries due to a metal-on-metal version of the artificial hip system continue to mount in a federal multidistrict litigation underway in Texas. According to a Master Case List issued in the U.S. District Court, Northern District of Texas on November 30th, 5,293 Pinnacle hip lawsuits are now pending in the proceeding. Court documents indicate that this is an increase of nearly 100 since the last update was issued on October 31st. (In re: DePuy Orthopaedics Inc. DePuy Pinnacle Lawsuits
According to court documents, all of the Pinnacle hip lawsuits pending in the Northern District of Texas involve a metal-on-metal version of the hip system that utilizes the Ultamet Liner. Plaintiffs in these claims allege that this all-metal design is prone to wear, which can result in the shedding of toxic metal ions into a recipient’s tissue and blood stream. The accumulation of these metal particles can allegedly result in metallosis, pain, failure of the hip, and other complications that may necessitate revision surgery to remove and replace the device. The lawsuits further allege that the metal-on-metal Pinnacle suffers from some of the same design defects that prompted DePuy Orthopaedics to recall the ASR hip in 2010. The complaints question whether or not a DePuy Pinnacle recall should be issued as well.
The U.S. Food & Drug Administration (FDA) warned in January 2013 that hip implants with a metal-on-metal design appeared to be failing at a higher rate than devices constructed of other materials. Among other things, the agency advised metal-on-metal hip implant recipients who experience pain and swelling around the joint, mobility issues, or other signs of a failing hip to undergo blood tests for elevated levels of metal ions. The agency has also proposed new rules for metal hips, including a requirement that manufacturers of metal-on-metal hips currently on the market conduct safety studies of their products if they plan to continue selling them.
According to a Bloomberg.com report from May 2013, the FDA’s regulatory stance regarding metal-on-metal hips played a role in DePuy’s decision to end sales of such devices, including the all-metal Pinnacle.*
