Thousands of DePuy Pinnacle hip lawsuits (http://www.depuypinnacle-lawsuit.com/) continue to progress in a multidistrict litigation now underway in U.S. District Court, Northern District of Texas, Bernstein Liebhard LLP reports. According to an Order dated December 4, 2013 the proceeding’s Special Master has agreed to delay consideration of Remand Motions in a number of Pinnacle hip lawsuits until the completion of the litigation’s bellwether trials, which are slated to begin in September 2014. Pinnacle Hip Lawsuits
According to court documents, the Motions for Remand governed by the December 4th Order involve more than 200 of the nearly 5,300 Pinnacle hip lawsuits now pending in the Northern District of Texas. All federally-file claims involving the metal-on-metal Pinnacle hip have been consolidated in that jurisdiction for the purposes of coordinated pretrial proceedings.
DePuy Pinnacle lawsuits similarly allege that a metal-on-metal version of the Pinnacle which utilizes the Ultamet liner is prone to wear, and can shed dangerous amounts of toxic metal ions into recipients’ tissue and blood stream. According to the filings, this phenomenon can result in metallosis, pseudotumor formation and other complications that could cause premature failure of the device. Among other things, the claims allege that the all-metal Pinnacle shares many of the flaws that prompted DePuy Orthopaedics to pull its ASR hip implant line from the market in 2010. They question whether or not the metal-on-metal Pinnacle should have been recalled as well.
In May 2010, Bloomberg.com reported that DePuy Orthopaedics had decided to end sales of metal-on-metal hips, including the version of the Pinnacle that utilizes the Ultamet liner. Among the reasons given for the decision were recent actions taken by the U.S. Food & Drug Administration (FDA) regarding the regulation of such devices, including a proposed rule that would require manufacturers of all-metal hips currently on the market to conduct safety studies of their products.*
Recipients of the all-metal DePuy Pinnacle hip may be entitled to financial compensation if they experienced metallosis, pseudotumors, premature failure of the hip, or any other complications allegedly related to its all-metal design.
