DePuy Pinnacle hip lawsuits ( alleging injury due to the metal-on-metal version of the hip replacement system continue to mount in the federal multidistrict litigation now underway in U.S. District Court, Northern District of Texas, Bernstein Liebhard LLP reports. According to a Master Case List issued by the Court on January 2, 2014, the number of Pinnacle hip lawsuits now pending in the proceeding has risen to 5,416. Court documents show that filings have increased by 123 since the Court’s previous update on November 30th, when it reported 5,293 claims. (In re: DePuy Orthopaedics Inc. DePuy Pinnacle Lawsuits
According to court documents, the DePuy Pinnacle hip involved in the federal litigation utilizes the Ultamet liner. Plaintiffs allege that the use of this liner results in a metal-on-metal design that is prone to wear, resulting in toxic metal particles being shed into a recipient’s tissue and blood stream. If enough of these particles accumulate in the surrounding tissue, patients can experience metallosis, pain, failure of the hip, and other complications that may necessitate revision surgery to remove and replace the device. The lawsuits further allege that this all-metal design is flawed in much the same way as DePuy Orthopaedics’ ASR hip implant, which was recalled in 2010. Plaintiffs question whether or not a DePuy Pinnacle recall should also be issued for the metal-on-metal version of the hip replacement device.

Last January, the U.S. Food & Drug Administration (FDA) issued a public statement on metal-on-metal hips, warning that this type of design appeared to be failing at a higher rate than devices constructed of other materials. Among other things, the agency advised metal-on-metal hip implant recipients to undergo blood tests if they experience pain and swelling around the joint, mobility issues, or other signs of a failing hip. The FDA has also proposed new rules for metal hips, including a requirement that manufacturers of metal-on-metal hips currently on the market conduct safety studies of their products if they plan to continue selling them.

According to a report from May 2013, increased FDA scrutiny of metal-on-metal hips helped to prompt a decision by DePuy Orthopaedics to end sales of such devices, including the all-metal Pinnacle.*

Recipients of the metal-on-metal Pinnacle hip that utilizes the Ultamet liner may be entitled to file their own DePuy Pinnacle lawsuit if they suffered metallosis, pain, premature failure of the hip, or other debilitating complications allegedly associated with its all-metal design.
