The Plaintiffs’ Steering Committee in the federal litigation involving DePuy Pinnacle hip lawsuits (http://www.depuypinnacle-lawsuit.com/ ) is challenging a Seattle, Washington hospital over a $1,000 charge the facility is seeking to assess a plaintiff for the preservation and return of her explanted hip implant, Bernstein Liebhard LLP reports. In a Position Statement filed with the U.S. District Court, Northern District of Texas on February 18, 2014, the Committee characterized the fee assessed by Swedish Medical Center as exorbitant, and notes that fees charged by other hospitals have ranged from $15 to $100. The Committee further asserts in the petition that “efforts to understand the cause of problems that patients experience with DePuy hips may be severely compromised if hospitals refuse to preserve and turn over explants or charge an exorbitant fee to do so.” (In re: DePuy Orthopaedics Inc. DePuy Pinnacle Hip Replacement Lawsuits

Court documents indicate that nearly 5,600 Pinnacle hip replacement lawsuits have been filed on behalf of plaintiffs who were allegedly injured by the metal-on-metal version of the hip implant system that utilizes the Ultamet liner. The proceeding’s first trial is scheduled to begin in September 2014.
The U.S. Food & Drug Administration (FDA) issued an alert in January 2013 that cautioned all-metal hip recipients, such as those involved in the Pinnacle hip litigation, to undergo metal ion blood testing if they experienced any symptoms that might mean their device was failing, including pain, swelling, or audible noises coming from their hip. The agency also proposed new rules that would subject metal-on-metal hip implants to stricter regulatory oversight.
According to a Bloomberg.com report from May 2013, increased FDA scrutiny of metal-on-metal hips helped to prompt a decision by DePuy Orthopaedics to end sales of such devices, including the all-metal Pinnacle.*
