A federal judge has denied defense motions for dismissal and summary judgment in two DePuy Pinnacle hip lawsuits (http://www.depuypinnacle-lawsuit.com/ ) selected as bellwether cases, paving the way for the claims to go before a jury on September 1, 2014, Bernstein Liebhard LLP reports. In an opinion rendered on July 18th, U.S. District Judge Ed Kinkeade of the Northern District of Texas, ruled that the two Plaintiffs’ claims may proceed to trial against Johnson & Johnson, the parent of DePuy Orthopaedics, and several affiliates. The cases scheduled to go to trial in September were filed by two Montana residents who allegedly suffered severe pain, metallosis (metal ion poisoning), and elevated levels of chromium and cobalt in their blood due to an all-metal version of the Pinnacle hip implant system that utilizes the Ultamet liner. According to court documents, their claims are among more than 6,400 DePuy Pinnacle lawsuits that have been consolidated in the Northern District of Texas for coordinated pretrial proceedings. In May 2013, Johnson & Johnson and DePuy Orthopaedics announced that they would cease the sale of metal-on-metal hip implants, including the device involved in Pinnacle hip lawsuits. The companies’ announcement came in the wake of an alert issued by the U.S. Food & Drug Administration (FDA) in January 2013, which warned that all-metal hips were more likely to fail early than those made of other materials. The agency also revealed that it was considering new rules that would subject the all-metal hips to greater regulatory oversight.*
