Thousands of DePuy Pinnacle hip lawsuits (http://www.depuypinnacle-lawsuit.com/) filed on behalf of individuals who were allegedly injured by a metal-on-metal version of the Pinnacle Hip Replacement System continue to move forward in U.S. District Court, Northern District of Texas, Bernstein Liebhard LLP reports. According to an Order issued on July 18, 2014, U.S. District Judge Ed Kinkeade has granted part of a motion filed by the Plaintiffs’ Steering Committee that sought the deposition of a witness and production of certain documents pertaining to the Deferred Prosecution Agreement entered into between DePuy Orthopaedics and the U.S. Department of Justice in April 2011. The remainder of the motion was denied without prejudice, to be re-argued following completion of the deposition. (In re: DePuy Orthopaedics Inc. According to court documents, the hip implant at issue in the federal DePuy Pinnacle litigation utilizes the Ultamet liner. In this configuration, the device becomes a metal-on-metal hip replacement. In January 2012, the U.S. Food & Drug Administration (FDA) warned that these types of hip replacements were more likely to fail early than those made of other materials. The agency also revealed that it was considering new rules that would subject the all-metal hips to greater regulatory oversight.

In May 2013, Johnson & Johnson and DePuy Orthopaedics announced that they would cease the sale of metal-on-metal hip implants, including the device involved in Pinnacle hip lawsuits.*

Court records indicate that more than 6,400 Pinnacle hip lawsuits are now pending in the litigation underway in the Northern District of Texas. All of the lawsuits claim that the metal-on-metal version of the Pinnacle hip replacement can shed dangerous amounts of toxic metal ions into the surrounding tissue and blood stream. Plaintiffs claim that this occurrence can cause a number of serious and debilitating complications, including metallosis (metal ion poisoning), chronic pain, and premature failure of the hip implant.

Bernstein Liebhard LLP partner, Jeffrey S. Grand, is serving on the Plaintiffs’ Steering Committee in the federal Pinnacle hip litigation. According to court documents, the first trial in the proceeding is expected to begin on September 1, 2014.
