DePuy Pinnacle hip lawsuits (http://www.depuypinnacle-lawsuit.com/) continue to move forward in the multidistrict litigation underway in the U.S. District Court, Northern District of Texas, Bernstein Liebhard LLP reports. According to court documents, the proceeding’s Special Master has issued a Proposed Order on August 19th pertaining to the litigation’s first bellwether trial, which is scheduled to begin on September 1st. Among other things, the Order would bar the parties from mentioning the standard of medical care provided by the plaintiffs’ surgeon. (In re: DePuy Orthopaedics Inc. Court records indicate that more than 6,400 Pinnacle hip lawsuits are now pending in the litigation underway in the Northern District of Texas, where Bernstein Liebhard LLP partner, Jeffrey S. Grand, is serving on the Plaintiffs’ Steering Committee. The two cases scheduled for trial on September 1st were filed on behalf of Pinnacle hip recipients from Montana who underwent revision of their hip replacement after allegedly developing pain, metallosis, and elevated blood serum levels of chromium and cobalt. All of the claims pending in this proceeding allege similar injuries due to a metal-on-metal version of the Pinnacle hip implant that utilizes the Ultamet liner.
In January 2013, the U.S. Food & Drug Administration (FDA) warned that metal-on-metal hips like the device at the center of the DePuy Pinnacle litigation were more likely to fail early than those made of other materials. The agency also revealed that it was considering new rules that would subject the all-metal hips to greater regulatory oversight.
In May 2013, Johnson & Johnson and DePuy Orthopaedics announced that they would cease the sale of metal-on-metal hip implants, including the device involved in Pinnacle hip lawsuits.*
Recipients of the metal-on-metal Pinnacle implant may be entitled to file their own claim if they experienced premature device failure, metallosis or other complications allegedly related to its all-metal design.
