Testimony Begins in First Federal DePuy Pinnacle Hip Lawsuit Trial, Bernstein Liebhard LLP Reports

According to a report from Bloomberg News, much of the proceeding on Thursday focused on internal company documents, including emails, regarding physicians’ concerns with metal-on-metal hips. Court records indicate that more than 6,000 Pinnacle hip lawsuits are currently pending in the Northern District of Texas, all of which include allegations that echo those at issue in this trial. All of the lawsuits involve a metal-on-metal version of the Pinnacle hip that utilizes the Ultamet liner, which plaintiffs claim can leech dangerous amounts of metal debris into a recipient’s tissue and blood stream. According to the complaints, this occurrence can result in chronic pain, metallosis, tissue and bone damage, and premature failure of the device necessitating revision surgery. According to court documents, the case currently at trial was filed on behalf of a Montana woman who underwent revision surgery just two years after receiving her Pinnacle hip replacement. Among other things, her lawsuit alleges that the metal ions shed from the device caused her to experience cobalt blood serum levels 85 times higher than normal.
Johnson & Johnson and DePuy Orthopaedics announced in May 2013 that they would end sales of the all-metal Pinnacle, as well as other metal-on-metal hip replacements. While the companies maintained that the decision was not driven by safety concerns, the announcement did follow an alert issued by the U.S. Food & Drug Administration (FDA) in January of that year that warned metal-on-metal hips were prone to early failure due to metal ions that may be released by the devices. **
