New Jersey Court Overseeing DePuy Pinnacle Hip Lawsuits Issues New Order, Bernstein Liebhard LLP Reports

DePuy Pinnacle hip lawsuits (http://www.consumerinjurylawyers.com/depuy-pinnacle/lawsuit) that allege a metal-on-metal version of the artificial hip system was defectively designed continue to move forward in state and federal courts, Bernstein Liebhard LLP reports. According to an Order filed in New Jersey’ Bergen County Superior Court on December 2nd, counsel in 10 DePuy Pinnacle lawsuits were permitted to begin deposition of plaintiffs on November 19, 2014, with depositions to conclude by March 15, 2014. The Order also directs counsel to meet and confer on the selection of one case for the Court’s first Pinnacle trial. If an agreement cannot be reached, the parties are to serve simultaneous submission on the Court and counsel by March 31, 2015. (In re: DePuy ASR Hip Implants Litigation, No. BER-L-3971-11)

Court documents indicate that thousands of people have filed DePuy Pinnacle hip lawsuits in U.S. courts that involve a metal-on-metal version of the hip system that utilizes the Ultamet liner. The majority of these claims are currently pending in a federal multidistrict litigation underway in U.S. District Court, Northern District of Texas, where more than 7,000 cases have been filed. According to court records, all of the claims involving the Pinnacle hip similarly allege that the all-metal design created by the use of the Ultamet liner makes the device prone to premature failure and other complications, including metallosis (metal ion poisoning) and chronic pain. Plaintiffs also allege that this configuration shares some of the design flaws that prompted DePuy Orthopaedics to recall its ASR hip implants in 2012, and question whether the all-metal Pinnacle should have been recalled as well.

Johnson & Johnson and its DePuy Orthopaedics subsidiary announced in May 2013 that they would stop selling metal-on-metal hip implants, including the all-metal version of the Pinnacle hip replacement that is at the center of this litigation. The companies have asserted that the move was driven by commercial concerns rather than safety issues. However, the announcement followed an alert published by the U.S.Food & Drug Administration (FDA) in January 2013, which warned that metal-on-metal hips were more likely to fail early than those made of other materials.*
