Federal DePuy Pinnacle Hip Lawsuits Move Forward, as Plaintiffs Seek to Modify Order Pertaining to Health Authorizations

Thousands of DePuy Pinnacle lawsuits (http://www.consumerinjurylawyers.com/depuy-pinnacle/lawsuit) continue to move forward in the federal multidistrict litigation now underway in U.S. District Court, Northern District of Texas. According to a Motion filed on May 20th, plaintiffs’ attorneys have asked the Court to modify the Case Management Order pertaining to the Limited Authorization to Disclose Health Information. Among other things, the Motion seeks the adoption of a new form that would specifically exclude certain information from the scope of the authorization. (In re: DePuy Orthopaedics Inc. Court records indicate that more than 7,500 cases were pending in DePuy Pinnacle litigation as of May 1st, all of which involve a metal-on-metal version of the DePuy Orthpaedics’ Pinnacle Hip Replacement System that utilizes the Ultamet liner. Plaintiffs allege that this design has a propensity to shed dangerous amounts of toxic metal debris, which places recipients at risk for metallosis, chronic pain, premature device failure and other complications that may necessitate revision surgery to remove and replace the device.
According to court documents, the federal DePuy Pinnacle litigation is currently in the process of selecting a case for its second bellwether trial. The first trial concluded last October with a verdict for the defense. (Case No. 11-cv-3590)
