DePuy Pinnacle hip lawsuits (http://www.depuypinnacle-lawsuit.com/ ) continue to move forward in a federal multidistrict litigation now underway in U.S. District Court, Northern District of Texas, Bernstein Liebhard LLP reports. According to an Order issued on July 30, 2013, the Court has scheduled the litigation’s next conference for September 10, 2013 at 2:30 p.m., CST. Among other things, the conference will address the selection of DePuy Pinnacle lawsuits for the litigation’s bellwether trials. (In re: DePuy Orthopaedics Inc. DePuy Pinnacle Hip Lawsuits
Court documents indicate that more than 4,400 DePuy Pinnacle lawsuits have been filed in the Northern District of Texas. The proceeding’s first bellwether trials are expected to begin in the fall of 2014. All of the lawsuits pending in the federal Pinnacle litigation allege that the all-metal version of the device, which utilizes the Ultamet liner, caused the recipient to suffer significant complications due to the propensity of the hip to shed dangerous amounts of metal ions into the tissue surrounding the implant, as well as the blood stream. Among other things, the complaints allege the all-metal Pinnacle suffers from the same design flaws that led to the DePuy ASR hip recall in 2010, and question whether it should have been recalled as well.
The U.S. Food & Drug Administration (FDA) has been investigating metal-on-metal hip implants since February 2011, amid mounting evidence that such devices can shed dangerous amounts of metal debris, leading to serious complications, including adverse local tissue reactions, premature device failure, and other long-term health consequences. On January 17th, the FDA proposed new rules that would subject such devices to greater regulatory scrutiny, including a rule that would require the manufacturers of metal-on-metal hips currently on the market to conduct post-market safety studies of those products in order to keep selling them. According to a New York Times report published on May 17th, DePuy Orthopaedics has decided to phase out sales of metal-on-metal hip implants, including the all-metal Pinnacle, in part due to recent FDA actions.*
