Missouri Truck Accident Lawyer Terry A. Tolbert Comments on Report of Fatal Truck Crash in Platte County

Tolbert commented on a report in KCTV 5 (“Semi-truck driver charged after crash that killed 1, injured 2 others, Oct. 29”) about a semi-truck driver who police reported was allegedly under the influence of alcohol when he collided with a mother’s minivan, resulting in her death and injuries to two others. (Case number 13AE-CR02843, Platte County Circuit Court, Division IV)

“Semi-trucks are among the largest vehicles on the highways,” said Tolbert, who represents victims of negligence and families who lost loved ones in accidents. “Accidents typically result in catastrophic or fatal injuries to the occupants of the smaller vehicle. While the cause of this recent Platte County accident is under investigation, we know that many senseless semi-truck accidents happen because of a driver’s negligence. And drivers are agents of the company they work for, so the trucking companies may be liable in these serious accidents.”

According to KCTV 5, the Platte County Sheriff’s Office believes that, based on its preliminary investigation, the accident occurred after the truck crossed the center line and struck the minivan. The driver of the semi-truck was taken into custody after the accident, and police are alleging that he was under the influence of alcohol, according to KCTV 5.

KCTV 5 reported that the accident occurred along a curve on a well-traveled commuter route along Highway 45 between Jones-Meyer Road and Interstate 45 that has seen multiple accidents in the past.

Tolbert said, "commercial truck drivers are held to a higher standard than drivers of passenger cars. For example, federal law prohibits truckers from texting in any state. The trucking company also has a duty to conduct a background check on the driving history of its employee."
