GranuFlo Lawsuits Move Forward, as Dialysis Clinic Seeks Dismissal of Missouri Lawsuit Pending in Federal Litigation, Bernstein Liebhard LLP Reports

According to court documents, a dialysis clinic that has been named a defendant in a case filed by a Missouri Plaintiff is seeking to have the claim dismissed from the proceeding. In a Memorandum filed on October 23, 2014, attorneys for the clinic point out that the Missouri Supreme Court has held that strict liability claims such as those put forth by the Plaintiff are not applicable to health care providers. The Memorandum further asserts that this reasoning is also applicable to the lawsuit’s negligent design and breach of warranty claims. (Case No. 1:14-cv-11965-DPW)

GranuFlo Recall Litigation
Court documents indicate that more than 2,100 GranuFlo and NaturaLyte lawsuits are currently pending in the litigation underway in the District of Massachusetts. All of these cases were filed on behalf of dialysis patients who allegedly experienced serious cardiovascular events, including heart attacks, strokes, and sudden cardiac death, due to the use of the two products. Among other things, the complaints accuse Fresenius Medical Care, the manufacturer of GranuFlo and NaturaLyte, of failing to provide adequate warnings regarding their serious cardiovascular risks. Plaintiffs also assert that the company continued to aggressively market the concentrates even after those dangers became known. GranuFlo and NaturaLyte are administered to kidney failure patients to remove toxins from the blood during dialysis treatments. In March 2012, Fresenius issued an Urgent Product Notification for GranuFlo and NaturaLyte that warned of dosage issues that could cause dialysis patients to suffer serious and catastrophic heart side effects. The U.S. Food & Drug Administration (FDA) ultimately granted Class I recall status to the Urgent Product Notification, which indicates the products posed a risk of serious injury and death.
Since the GranuFlo recall was announced in 2012, thousands of people have filed product liability claims against Fresenius. In addition to the cases pending in the District of Massachusetts, additional GranuFlo and NaturaLyte lawsuits have been consolidated on the state level in the Massachusetts’ Middlesex County Superior Court.
