GranuFlo lawsuits ( filed in the wake of the 2012 GranuFlo and NaturaLyte dialysis concentrate recall continue to move forward in the federal litigation underway in U.S. District Court, District of Massachusetts, Bernstein Liebhard LLP reports. According to court documents, a dialysis clinic that has been named a defendant in a case filed by a Missouri Plaintiff is seeking to have the claim dismissed from the proceeding. In a Memorandum filed on October 23, 2014, attorneys for the clinic point out that the Missouri Supreme Court has held that strict liability claims such as those put forth by the Plaintiff are not applicable to health care providers. The Memorandum further asserts that this reasoning is also applicable to the lawsuit’s negligent design and breach of warranty claims. (Case No. 1:14-cv-11965-DPW)

“Our Firm has filed numerous cases in the federal proceeding on behalf of individuals who were allegedly injured by GranuFlo and NaturaLyte. We will continue to monitor developments closely,” says Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices. The Firm is currently offering free GranuFlo lawsuit evaluations to dialysis patients who allegedly suffered cardiac arrest, heart attacks, stroke, sudden cardiac death or other side effects within 72 hours of a dialysis treatment involving the use of GranuFlo or NaturaLyte dialysis drugs.

GranuFlo Recall Litigation
Court documents indicate that more than 2,100 GranuFlo and NaturaLyte lawsuits are currently pending in the litigation underway in the District of Massachusetts. All of these cases were filed on behalf of dialysis patients who allegedly experienced serious cardiovascular events, including heart attacks, strokes, and sudden cardiac death, due to the use of the two products. Among other things, the complaints accuse Fresenius Medical Care, the manufacturer of GranuFlo and NaturaLyte, of failing to provide adequate warnings regarding their serious cardiovascular risks. Plaintiffs also assert that the company continued to aggressively market the concentrates even after those dangers became known. (In re Fresenius GranuFlo/Naturalyte Dialysate Litigation, MDL No. 2428)

GranuFlo and NaturaLyte are administered to kidney failure patients to remove toxins from the blood during dialysis treatments. In March 2012, Fresenius issued an Urgent Product Notification for GranuFlo and NaturaLyte that warned of dosage issues that could cause dialysis patients to suffer serious and catastrophic heart side effects. The U.S. Food & Drug Administration (FDA) ultimately granted Class I recall status to the Urgent Product Notification, which indicates the products posed a risk of serious injury and death.

Since the GranuFlo recall was announced in 2012, thousands of people have filed product liability claims against Fresenius. In addition to the cases pending in the District of Massachusetts, additional GranuFlo and NaturaLyte lawsuits have been consolidated on the state level in the Massachusetts’ Middlesex County Superior Court. Filings indicate that more than 3,900 claims are pending in that proceeding. (In re: Consolidated Fresenius Cases, No. MICV2013-03400-O).

Dialysis patients who allegedly suffered a serious cardiovascular event within 72 hours of the administration of Granuflo or NaturaLyte may be entitled to pursue a case against Fresenius Medical Care.
