GranuFlo Recall Litigation Grows, as Bernstein Liebhard LLP Notes the Filing of Nearly A Dozen New GranuFlo and NaturaLyte Lawsuits

According to The Glasgow Daily Times, 11 new claims were recently filed in Kentucky’s Barren Circuit Court on behalf of individuals who suffered fatal cardiovascular events that were allegedly caused by the administration of GranuFlo or NaturaLyte during dialysis treatments. Like thousands of other GranuFlo and NaturaLyte claims pending in U.S. courts, these cases assert claims of negligence, breaches of warranty, fraud, and violation of consumer protection laws. The complaints also seek loss of consortium for spouses and family members of the deceased, as well as wrongful death.*

In March 2012, Fresenius Medical Care issued an Urgent Product Notification for both concentrates that warned of dosage issues that could put patients at risk for serious and potentially life-threatening heart side effects. The U.S. Food & Drug Administration (FDA) ultimately granted Class I recall status to the Urgent Product Notification, which indicates that a medical product poses a risk of serious injury or death.
Since the announcement of the GranuFlo recall, court records indicate that thousands of lawsuits have been filed across the country on behalf of individuals who allegedly suffered heart attacks, strokes, and other serious cardiovascular events due to the administration of GranuFlo and NaturaLyte. This includes more than 2,220 cases that are now pending in a federal multidistrict litigation now underway in U.S. District Court, District of Massachusetts, where Bernstein Liebhard LLP is currently filing claims.
