A West Virginia man’s GranuFlo lawsuit against Fresenius Medical Care Holdings Inc., maker of GranuFlo and NaturaLyte, was removed to federal court on July 23. Plaintiff Phillip Ray Harris alleges that Fresenius sold the two dialysis drugs despite knowing about their dangerous heart side effects, according to court documents, reports GranuFlo and NaturaLyte law firm Rottenstein Law Group LLP.

Shirley Harris, the wife of Phillip, used both GranuFlo and NaturaLyte as part of her dialysis regimen, according to court documents (Phillip Ray Harris v. Fresenius Medical Care Holdings Inc.; 2:13-cv-20858, U.S. District Court for the Southern District of West Virginia). One alleged adverse side effect of the drugs is heart attack, which Phillip alleges his wife suffered from, and later died as a result of, following her use of the drugs.

The removal was ordered because the amount of damages Harris seeks exceeds $75,000 and the plaintiff and defendant are in different states (Harris in West Virginia and Fresenius in Massachusetts), according to the court documents.
