Greenberg Traurig Advises Behring Regional Center in Successful Challenge to USCIS Interpretation of the EB-5 Reform and Integrity Act
Global law firm Greenberg Traurig, LLP advised Behring Regional Center, a U.S. Citizenship and Immigration Services (USCIS) designated regional center, in reaching a settlement agreement with USCIS over its posted interpretation of the EB-5 Reform and Integrity Act (RIA) passed in March 2022.
MCLEAN, Va., Aug. 26, 2022 /PRNewswire-PRWeb/ -- Global law firm Greenberg Traurig, LLP advised Behring Regional Center, a U.S. Citizenship and Immigration Services (USCIS) designated regional center, in reaching a settlement agreement with USCIS over its posted interpretation of the EB-5 Reform and Integrity Act (RIA) passed in March 2022.
In April, USCIS posted an interpretation of the legislation that would nullify all 600-plus designated regional centers and require all entities to be re-designated in order to be authorized to file petitions.
The interpretation was challenged by the EB-5 Investment Coalition through Behring Regional Center, a coalition member. Provisions of the agreement, which is still under review by the court but is expected to be approved, include an acknowledgement by USCIS that regional centers validly authorized to operate prior to June 30, 2021 did not lose their designation because of the RIA.
