Hill, Kertscher & Wharton, LLP Wins Inter Partes Review at PTAB
ATLANTA (PRWEB) June 03, 2019 -- Attorneys Vivek Ganti and Blake Frye of Atlanta-based law firm Hill, Kertscher & Wharton, LLP were recently successful in one phase of complex patent litigation involving their client, Blacoh Fluid Control Incorporated. The Inter Partes Review proceedings were held in front of the Patent Trial and Appeal Board and involved two patents asserted against a competitor, Syrinix, Incorporated. (Syrinix, Inc. v. The Board’s rulings have particular significance on intellectual property litigation because it contingently allowed Blacoh to amend claims in each of the two patents, noting that the “patent owner has shown the proposed claims meet the statutory requirements… and procedural requirements.” A recent PTAB study showed that motions to amend were filed in only 10% of Inter Partes Review cases, and that only 21 out of 205 were granted at least in-part.

The case will eventually return to the federal district court in San Francisco (Blacoh Fluid Controls, Inc. v. Syrinix, Inc., Case No. 17-cv-04007, N.D. Cal. Feb. 21, 2018) for further litigation where additional issues of infringement will be decided.
