Lipitor Lawsuit Hearing Rescheduled for February after Winter Weather Postponement, Bernstein Liebhard LLP Reports

The U.S. Judicial Panel on Multidistrict Litigation (JPML) was scheduled to hear oral arguments over the creation of a centralized Lipitor diabetes lawsuit proceeding on January 30th in New Orleans, before weather complications caused by Winter Storm Leon resulted in a barrage of flight cancellations and other transportation issues to the Louisiana city. The hearing has since been rescheduled for February 6, 2014 at 9:00 a.m. Among the items listed on this meeting’s agenda will be a discussion of lawsuits filed on behalf of women who allegedly developed Type 2 diabetes after taking the statin, court records indicate. Court documents show that more than 100 Lipitor lawsuits against the drug’s manufacturer, Pfizer Inc. have been filed in the U.S, and that the JPML’s upcoming hearing will be the second time oral arguments regarding the consolidation of cases will have been heard. The first was in April 2013, when plaintiffs’ request for a multidistrict litigation was rejected by the Panel on the grounds that only about a dozen Lipitor-related cases had been filed, which was not enough to warrant one.
Although no decision has been made on the creation of a Lipitor lawsuit litigation, a number of claims are currently pending in two U.S. federal courts. In October 2013, a federal judge ordered that all cases filed in the U.S. District Court for the Southern District of Illinois be coordinated in that jurisdiction, and all claims pending in the U.S. District Court, District of South Carolina remain there for pretrial purposes. At the time, the Order indicated that 14 cases were being informally coordinated in the South Carolina court. (Hines v.Pfizer Inc., No. 13-404)
Lipitor lawsuits allege that Pfizer Inc. failed to adequately warn patients and their doctors about the cholesterol drug’s potential to cause new-onset Type 2 diabetes, and that the U.S. Food and Drug Administration(FDA) ’s February 2012 mandate to include the risk on its labeling is insufficient.
The federal agency’s order to note Lipitor’s association with diabetes was issued after the findings of a study published in JAMA: Internal Medicine found that post-menopausal women treated with the statin may be more likely to develop the disease.*
