Lipitor Lawsuits Move Forward, as Pfizer Seeks Dismissal of Texas Diabetes Claims Pending in Multidistrict Litigation, Bernstein Liebhard LLP Reports

According to a Motion filed in the U.S. District Court, District of South Carolina, on October 3rd, Pfizer, Inc. is seeking the dismissal of at least 10 Lipitor diabetes claims filed in the federal multidistrict litigation on behalf of Texas residents. Among other things, the company asserts that under Texas law, manufacturers of prescription medications are not liable for product liability claims so long as warnings included on a drug’s label were approved by the U.S. Food & Drug Administration (FDA). Court documents indicate that at least 1,270 Lipitor lawsuits have been filed in the District of South Carolina on behalf of plaintiffs who allege the medication increases the risk that a patient will develop Type 2 diabetes. Among other things, the complaints accuse Pfizer of being aware of the association between the medication and diabetes, and of concealing this knowledge from doctors and patients.
According to court records, the Lipitor litigation has been growing since February 2012, when the U.S. Food & Drug Administration (FDA) ordered the manufacturers of statin drugs to include information on their labels regarding a possible association between their use and Type 2 diabetes. The FDA acted after a study published in JAMA: Internal Medicine indicated that women using the medications may be at an increased risk of developing the disease.** Plaintiffs who have filed Lipitor lawsuits maintain that the label modification instituted by Pfizer at that time was inadequate, and still does not sufficiently warn Lipitor users that they may be at increased risk for Type 2 diabetes.
