Federal Lipitor Lawsuits Progress, As Court Selects Cases for First Bellwether Trials, Bernstein Liebhard LLP Reports

According to court documents dated January 30th, the Court has designated four cases as bellwether trial candidates: Daniels v. Pfizer, Case No. 2:14-1400; Hempstead v. Pfizer, Case. No. 2:14-1879; Radon v. Pfizer, Case No. 2:14-1502; and Durocher v. Pfizer, Case No. 7:13-1965. Daniels v. Pfizer will be the first to go to trial in October 2015. Lipitor Diabetes Litigation
Lipitor is a statin medication used to lower cholesterol in conjunction with diet and exercises. In February 2012, the U.S. Food & Drug Administration (FDA) announced that the labels for Lipitor and other statins would be updated to include new information about their potential association with Type 2 diabetes. The label change was prompted by the publication of a study in JAMA: Internal Medicine the previous month which suggested that post-menopausal women treated with statins faced an increased risk of developing new-onset Type 2 diabetes. *
Since then, court documents indicate that more than 2,000 Lipitor diabetes claims have been filed in the multidistrict litigation underway in South Carolina, all of which allege that use of the statin increases the risk that a patient will develop Type 2 diabetes. Pfizer, Inc., the manufacturer of Lipitor, is also accused of concealing its alleged association with diabetes in order to protect sales of the medication. Plaintiffs further assert that the label modifications made by Pfizer following the FDA’s 2012 mandate still do not sufficiently inform patients about the potential association between Lipitor and diabetes.
