Mesh Lawsuits Involving C.R. Bard, Ethicon Transvaginal Mesh Devices Continue to Mount in New Jersey State Litigation, Bernstein Liebhard LLP Reports

Bard, Inc. and Ethicon, Inc. continue to mount in litigations now underway in New Jersey’s Atlantic County Superior Court. As of July 13th, court documents indicate that just over 3,980 Ethicon mesh lawsuits have been filed in the New Jersey litigation, while another 739 claims were pending in the C.R. Bard proceeding. Bard vaginal mesh products. They further allege that the companies failed to provide adequate warnings about the serious risks associated with their products.

Bard and other manufacturers are named in more than 20,000 vaginal mesh lawsuits in multidistrict litigations underway in U.S. District Court, Southern District of West Virginia. In July 2011, the U.S. Food & Drug Administration (FDA) revealed that it had received more than 3,800 reports of serious complications involving transvaginal mesh products between 2005 and the end of 2010. The agency also changed its position regarding the frequency of such injuries in pelvic prolapse repair, declaring it no longer considered these complications to be rare.* Yet in spite of these issues, the FDA has not announced a mesh recall for any products manufactured by C.R. Bard, Ethicon or others.
