Bard got underway this week in the U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. According to court documents, jury selection for the trial has been completed, and opening arguments will commence soon. The Plaintiff, who received an Avaulta Plus device in 2009, claims in her vaginal mesh lawsuit that the defective nature of the product caused her to suffer serious complications that resulted in multiple corrective surgeries. Vaginal mesh lawsuits have been mounting against C.R. Bard and other manufacturers since 2008, when the U.S. Food & Drug Administrations (FDA) issued the first of two Public Health Alerts that warned of a high rate of serious complications among women who received transvaginal mesh implants in surgeries to repair pelvic organ prolapse and stress urinary incontinence. In a second alert released in July 2011, the agency declared that injuries associated with their use in prolapse repair could no longer be considered rare.
According to court documents, C.R. Bard is facing nearly 4, 550 mesh lawsuits in the federal multidistrict litigation underway in West Virginia. (In re C.R. Bard Inc.
