According to a Case Management Order issued on March 13, 2014, the Court has approved procedures for the electronic service of documents in order to facilitate expeditious, efficient, and economical communication by and amongst counsel. “Our Firm is representing numerous women in this proceeding who allegedly experienced migration of their IUD, as well as uterine perforations and other related Mirena complications. We are pleased to see additional progress in this litigation,” says Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices. The Firm is currently offering free Mirena lawsuit evaluations to women who may have been injured due to the spontaneous migration of their IUD.

Mirena IUD Lawsuits
According to court documents, more than 660 Mirena IUD lawsuits have been filed in New Jersey by women who allegedly suffered uterine perforations, organ damage, infections, scarring, ectopic pregnancies and other injuries following the spontaneous migration of the contraceptive device. Among other things, the lawsuits claim that Bayer Healthcare Pharmaceuticals has a history of downplaying the risks associated with Mirena, and exaggerating its purported benefits. The claims also point out that the labeling for the Mirena IUD only warns that the device may migrate if the uterus is perforated during its insertion. Women in Mirena lawsuits allege that they experienced device migration long after the IUD had been properly implanted by a healthcare provider. In addition to the claims pending in New Jersey, court records indicate that at least 428 federally-filed Mirena lawsuits involving similar allegations are pending in the U.S. District Court, Southern District of New York.

Bayer brought the Mirena IUD to market in the U.S. in 2000, and the device is now approved as both a method of birth control and as a treatment for heavy menstrual bleeding in women who wish to use an IUD for contraception. According to a report that aired on 7 Action News this past summer, the U.S. Food & Drug Administration (FDA) has received more than 70,000 complaints involving Mirena, including thousands that detail cases of device dislocation and uterine perforation, since the IUD was first launched.*

In December 2009, the FDA issued a Warning Letter to Bayer Healthcare Pharmaceuticals after finding that one of the company’s Mirena promotions made misleading claims about the safety and efficacy of the IUD.

Women who have allegedly experienced serious Mirena complications related to spontaneous migration of the IUD may be entitled to financial compensation for their injury-related damages.
