Mirena IUD Lawsuit Plaintiff in Alabama Allowed to Move Forward With Majority of Claims, Bernstein Liebhard LLP Reports

According to court documents, an Alabama federal judge will allow a Mirena lawsuit Plaintiff to pursue allegations that the levonorgestral released by Mirena caused her to develop idiopathic intracranial hypertension, a condition that can result in migraine-like headaches, blurred vision, double vision, temporary blindness, blind spots, or other visual deficiencies, as well as permanent vision loss. According to an Order dated March 28, 2014, Judge William M. Acker Jr. of the U.S. District Court, Northern District of Alabama, rejected Bayer Healthcare Pharmaceutical’s assertion that the Plaintiff’s claims of negligent design, strict liability, breach of express warranty and fraud were not sufficiently pleaded. However, Judge Acker did dismiss a claim of breach of implied warranty put forth in the complaint. (Houston v. Bayer Healthcare Pharmaceuticals Inc., No. 2:14-35)

Mirena IUD Lawsuits
The Mirena IUD was brought to market by Bayer Healthcare Pharmaceuticals in 2000, and is now approved as both a contraceptive and as a treatment for heavy menstrual bleeding in women who wish to use an IUD for contraception. In August, an investigation conducted by 7 Action News in Detroit found that since its approval, the U.S. Food & Drug Administration (FDA) has received more than 70,000 complaints involving Mirena, including thousands that detail cases of device dislocation and uterine perforation.*
In December 2009, the FDA issued a Warning Letter to Bayer Healthcare Pharmaceuticals after finding that one of the company’s Mirena promotions made misleading claims about the safety and efficacy of the IUD.
Court documents indicate that more than 1,000 lawsuits have been filed in state and federal courts on behalf of women who allegedly suffered serious Mirena complications due to spontaneous migration of the IUD. These include more than 650 Mirena lawsuits currently pending in a multicounty litigation underway in New Jersey’s Bergen County Superior Court. (In Re: Mirena Litigation; Case No. 297)
An additional 428 complaints involving similar allegations have also been filed in a federal multidistrict litigation underway in U.S. District Court, Southern District of New York. (In re: Mirena IUD Products Liability Litigation, MDL No. 2434)
According to court documents, all of the complaints pending in these litigations claim that Bayer Healthcare Pharmaceuticals has a history of downplaying the risks associated with Mirena, and exaggerating its purported benefits. The lawsuits also point out that the labeling for the Mirena IUD only warns that the device may migrate if the uterus is perforated during its insertion. Finally, plaintiffs are alleged to have suffered a wide range of serious Mirena complications due to spontaneous device migration, including uterine perforations, organ damage, infections, scarring, ectopic pregnancies and infertility.
