Mirena IUD Lawsuit Filings Exceed 920 in New Jersey Litigation, Bernstein Liebhard LLP Reports

According to a new case list issued last month in New Jersey, at least 924 Mirena lawsuits involving such allegations are pending in a multicounty litigation underway in Bergen County Superior Court. Mirena Lawsuits
The Mirena IUD is a long-acting contraceptive device that was first approved by the U.S. Food & Drug Administration (FDA) in 2000. It is inserted directly into the uterus by a healthcare provider, where it releases a synthetic progesterone for up to five years. In 2009, its approved uses were expanded to include the treatment of heavy menstrual bleeding in women who wish to use an IUD for birth control. In December 2009, the FDA also issued a warning letter to Bayer Healthcare Pharmaceuticals after finding that one of its Mirena promotions overstated the IUD’s benefits and downplayed its risks.
According to court documents, all of the Mirena IUD lawsuits pending in the New Jersey litigation allege that the device spontaneously migrated from its proper position in the uterus, despite having been correctly implanted by a healthcare professional. Plaintiffs claim that this occurrence led to a number of serious Mirena complications, including uterine perforations, scarring, adhesions and infertility, which in many cases required emergency treatment and surgical intervention.
Court records indicate that in addition to the claims pending in New Jersey, an additional 612 Mirena lawsuits involving similar allegations have been filed in a federal multicounty litigation now underway in U.S. District Court, Southern District of New York.
