Mirena IUD Lawsuit News: New Case Management Order Issued in New Jersey Mirena Litigation, Bernstein Liebhard LLP Reports

Court records indicate that a new Case Management Order was filed in the proceeding on August 5th that, among other things, establishes protocols for the filing of certain Defense Motions. The complaints further allege that Bayer Healthcare Pharmaceuticals failed to warn that spontaneous IUD migration could occur with Mirena.
In addition to the cases pending in New Jersey, court documents show that at least 612 additional Mirena lawsuits involving similar allegations have been filed in a federal multicounty litigation now underway in U.S. District Court, Southern District of New York. The Mirena IUD is a long-acting method of birth control that was first approved by the U.S. Food & Drug Administration (FDA) in 2000. In 2009, its approved uses were expanded to include the treatment of heavy menstrual bleeding in women who wish to use an IUD for birth control. In December 2009, the FDA also issued a warning letter to Bayer after finding that one of its Mirena promotions exaggerated the IUD’s benefits and understated its potentially serious side effects.
