Mirena IUD Lawsuit News: JPML Rejects Consolidation of Mirena Lawsuits Involving Brain Injury Allegations, Bernstein Liebhard LLP Reports

A panel of federal judges has declined a request by some Mirena IUD lawsuit (http://www.injurybeacon.com/mirena-iud/lawsuit/) plaintiffs to consolidate certain claims involving brain injuries in a federal multidistrict litigation, Bernstein Liebhard LLP reports. While the U.S. Judicial Panel on Multidistrict Litigation (JPML) acknowledged in its August 12th Order that there might be some benefit to consolidating the cases, the Panel found that the small number of filings did not warrant the creation of a new multidistrict litigation. Among other things, the Order noted that Bayer Healthcare Pharmaceuticals had agreed to share any overlapping discovery among the pending cases, and that the docket is “well-positioned for informal coordination.” (Ire: Mirena IUS Levonorgestrel-Related Products Liability Litigation, MDL No. 2559)

Mirena IUD Lawsuits
The Mirena IUD was brought to market by Bayer Healthcare Pharmaceuticals in 2000, and is now approved as both a contraceptive and as a treatment for heavy menstrual bleeding in women who wish to use an IUD for contraception. All of the claims affected by the JPML’s August 12th Order allege that exposure to levonorgestrel, the synthetic progestin released by the Mirena, can result in non-stroke neurological complications related to increased pressure on the brain from a build-up of cerebrospinal fluid, including pseudotumor cerebri (PTC, also known as idiopathic intracranial hypertension or IIH). According to court documents, nine lawsuits involving such allegations are currently pending in six federal courts.

Court documents indicate that more than 920 Mirena lawsuits have been filed in New Jersey’s Bergen County Superior Court on behalf of women who allegedly suffered serious Mirena complications related to spontaneous migration of the device, including uterine perforations, organ damage and infertility. The lawsuits further allege that Bayer did not warn doctors or patients that the IUD could spontaneously migrate from its proper position in the uterus, even following correct implantation. According to the complaints, the labeling for the Mirena IUD merely warns that the device may migrate if the uterus is punctured during its initial insertion.
