Mirena IUD Lawsuit Plaintiff in California Granted Access to Bayer Sales Call Notes, Bernstein Liebhard LLP Reports

Mirena IUD lawsuits (http://www.mirenalawsuit2014.com/) filed on behalf of women who were allegedly injured by the contraceptive device continue to move forward in courts throughout the U.S., Bernstein Liebhard LLP reports. According to court documents, a federal judge presiding over one such case in the U.S. District Court, Northern District of California has ordered Bayer Healthcare Pharmaceuticals to produce certain notes pertaining to sales calls the company’s representatives made to physicians to promote the IUD. In an Order dated October 31, 2014, U.S. Magistrate Judge Kandis A. Westmore found that the documents in question might support the Plaintiff’s claims that Bayer’s promotional materials for Mirena minimized the IUD’s risk warnings. While Bayer had sought to limit the Plaintiff’s access to notes that only concerned her treating physicians, the Order directs the company to produce all notes that were already subject to discovery in the related multidistrict litigation underway in New York federal court. According to court records, all of the Mirena lawsuits now pending in U.S. courts accuse Bayer Healthcare Pharmaceuticals of failing to warn that the device might migrate even after being properly inserted into the uterus by a healthcare provider, and point out that the product’s label only cautions that migration might occur if the uterus is perforated when the IUD is being implanted. The lawsuits also site a 2009 warning letter Bayer received from the U.S. Food & Drug Administration for using promotional materials that overstated the benefits purportedly associated with Mirena, and that also downplayed the risk for serious complications.
