Mirena Lawsuit News: Court Establishes Requirements for Plaintiff Fact Sheets in New Jersey Mirena Litigation, Bernstein Liebhard LLP Reports

According to an Order dated on April 11, 2014, the Court has established core criteria for the completion of Plaintiff Fact Sheets, which are required to be submitted by all plaintiffs who have filed Mirena IUD lawsuits in the proceeding. Among other things, the Court has stipulated that defendants will be permitted to issue a Deficiency Letter to any plaintiff who fails to answer one or more of the core criteria questions specified by the Order. If the plaintiff fails to provide the required answers within 30 days of the issuance of that letter, their claim may be subject to dismissal. (In Re: Mirena Litigation; Case No. 297)

According to court documents, more than 700 lawsuits have been filed in Bergen County Superior Court on behalf of women who allegedly suffered serious Mirena side effects, including uterine perforations, infections, scarring, and infertility, due to spontaneous migration of their IUD. Among other things, plaintiffs claim that Bayer Healthcare Pharmaceuticals failed to provide adequate warnings regarding the propensity of the Mirena IUD to spontaneously migrate from its proper position in the uterus, and point out that the Mirena label only states that migration may occur if the uterus is punctured during insertion. All of the women who have filed Mirena IUD lawsuits in this proceeding allege that their IUD was correctly inserted by their doctor, and that the migration they experienced was not the result of improper placement.
In addition to the New Jersey litigation, nearly 500 additional Mirena lawsuits that raise similar allegations regarding spontaneous IUD migration have been consolidated for pretrial proceedings in the U.S. District Court, Southern District of New York. The Mirena IUD is a long-acting birth control method that was approved by the U.S. Food & Drug Administration (FDA) in 2000. In 2009, the agency expanded its approved uses to include the treatment of heavy menstrual bleeding in women who wish to use an IUD as their method of contraception. That same year, the FDA issued a Warning Letter to Bayer Healthcare Pharmaceuticals after finding that one of the company’s Mirena promotions made misleading claims about the safety and efficacy of the IUD.
According to a report that aired on 7 Action News this past summer, the FDA has received more than 70,000 complaints involving Mirena side effects, including thousands that detail cases of device dislocation and uterine perforation, since the IUD was first brought to market in 2000.*
